Regular Council Meeting
May 3, 2011

Meeting called to order by Mayor Harley at 7:00pm.

Invocation given by Pastor Jason Comer.

Pledge of Allegiance led by Boy Scout

Welcome extended to all by Mayor Harley.

Present were Mayor John R. Harley, Councilman Randall Wright, Councilman Robert Smith, Jr., City Administrator Patrick Eidson and City Attorney Rebecca Tydings.  Absent: Councilman Cameron Andrews (sick) and Councilman Edward Tucker unable to Skype into meeting.

Proclamation “Debbie Meck”:  Mayor Harley read proclamation and stated it will be presented to Mrs. Meck Friday May 6, 2011 at Centerville Elementary School.  Mrs. Meck has served 31 years teaching at CES.   Mayor Harley will present at formal ceremony Friday May 6, 2011.

Adoption of Minutes:  Motion made by Councilman Smith to adopt minutes as a group as written; seconded by Councilman Wright.  Motion carried.

Old Business

2nd Official Reading Ordinance-Annexation for Services and Covenant for Future Annexation:  City Attorney Tydings as discussed at the Council work session was instructed to draft ordinance.  Mrs. Tydings has drafted ordinance and covenant.  This ordinance contemplates two scenarios as follows:  1. A property owner, who is eligible for annexation (contiguous and within our service delivery area), requests connection to the City’s sewer system.  That property owner would be required to submit an application for annexation in order to receive permission to tap on to the sewer system.  1.  A property owner who is not currently eligible for annexation (within our service delivery area but not contiguous to the city) requests connection to the City’s sewer system. That property owner would be required to provide proof of deed showing ownership of property and would also be required to execute a “covenant for future annexation.”  The covenant would be recorded in the chain of title to provide notice for successors in interest that annexation had been agreed to for the subject property as soon as it became eligible (contiguous).  (The current owner would also be required to be annexed as soon as the property became contiguous to the city.)  

If the Governing Authority approves tonight City Clerk Bedingfield will send to Municode to update ordinances.  Originals will be kept in the City Clerk’s Office. 
Motion made by Councilman Wright to approve ordinance as written; seconded by Councilman Smith.  Motion carried.  See Ordinance 2011-2.

Rebuilding Together Request for Funding:  Mayor Harley reminded everyone of letter received requesting $1500.00 to assist with low income elderly citizens’ housing repairs.  Mayor Harley does not agree with honoring request because the donated funds would come from taxpayer’s money.  Mayor Harley made recommendation to deny request.

Motion made by Councilman Smith to deny request; seconded by Councilman Wright.  Motion carried.  Instructed City Administrator Eidson to draft letter declining solicitation for Mayor Harley’s signature. 

City of Ethics Update:  Councilman Smith stated that the process has changed and cities have to re-certify or renew their City of Ethics designation.  Councilman Smith has received a letter received from GMA acknowledging receipt of renewal request.  City Attorney Tydings is on the GMA committee that will be reviewing submissions for city of ethics.

New Business

Presentation FY2011-2012 to Mayor and Council:  City Administrator Eidson provided copy of presentation.  The subcommittee comprised of Councilman Smith and Councilman Wright met with Department Heads to review budget request.  This contains the breakdown for the FY 2011-2012 Budget.  The Budget Hearing will be June 7, 2011 Regular Council Meeting at 7:00pm.

City Administrator Eidson stated that he was very pleased with Department Heads providing justifications for expenditure.  

Councilman Wright commended City Administrator Eidson and City Accountant and Department Heads doing a “Fantastic” job in budget process.    Councilman Smith echoes comments.  

Council Planning Retreat:  Mayor Harley/ City Administrator Eidson provided a copy of draft agenda and cost for retreat.  The facilitator would be Walt McBride; he has served on our last 2 planning retreats.  The draft agenda covers items from last year’s report.  City Administrator Eidson is asking everyone to review the draft agenda to get the discussion rolling and identify benchmarks on certain items regarding progress.  Mr. McBride has created a survey questionnaire to gather data to see where we (City/ Mayor and Council/Department Heads) are currently.  An agenda will be finalized based on responses to the questionnaire.

Motion to discuss by Councilman Wright; seconded by Councilman Smith. 

Councilman Wright stated that the retreat has been beneficial.  Councilman Smith strongly recommends approving planning retreat for June 29 & 30, 2011. 

Motion made by Councilman Wright to authorize expenditure and approve retreat dates June 29 & 30, 2011; seconded by Councilman Smith.  Motion carried. 

The designated funding source will be the General Fund Contingency.  

Employee Safety Handbook:  City Administrator Eidson provided copy of draft safety handbook.  City Attorney Tydings provided feedback along with Department Heads and language included is comparable to the city.  Please review and provide feedback.  Recommendation to adopt at the May Council Work Session meeting.  GMA has a funding program that member cities can apply to and receive funds to purchase safety equipment (gloves, helmets etc.)   Training will be provided and employees will receive a copy of the manual. 

City Attorney left meeting early at 7:36pm to attend a family event.

James Ermancyzk, 123 South George Street, Apt 21:  Commented on the new stop light to be placed at Margie and Gunn Rd. 

Pastor Jason Comer, opening new church at the Galleria Conference Center, non-denominational church and hopes everyone will understand it is open to all people. He wants the church to be known for a place to come and hear the message of the bible and partner with the City of Centerville.  Would like to partner with any organization that cares about humanity.
